Washington, D.C. - The Department of Health and Human Services (HHS), in a landmark move, has finalized a rule that sets new benchmarks for transparency and accountability in the development of artificial intelligence (AI) within health IT software. This initiative, led by the HHS' Office of the National Coordinator for Health Information Technology (ONC), is poised to significantly reshape the landscape of healthcare technology.

Titled ‘Health Data, Technology, and Interoperability: Certification Program Updates, Algorithm Transparency, and Information Sharing,’ the rule introduces technical transparency and risk-management requirements for healthcare software systems that utilize AI and predictive algorithms.
Key mandates include:
Micky Tripathi, national coordinator for health IT, emphasized the importance of transparency in a hearing held by the House Committee on Energy and Commerce, noting, "One of the things the rule does is it creates transparency, first and foremost, because I think we have to start with transparency."
The rule, which narrows its focus primarily to EHR developers, is a response to concerns from major players like Epic and Oracle Health. It also updates interoperability standards within the ONC’s certification program, promoting more accurate patient characteristics data related to health equity and public health interoperability.
